Urgent Action. A cease of labor and operations began today in the Mexican state of Durango at La Platosa Mine.
A cease of labor and operations began today in the Mexican state of Durango at La Platosa Mine, a company owned and operated by the Canadian mining firm Excellon Resources Incorporated.
This act was led and supported by the mine manager, Paul Gurrola, as a coordinated effort against the union organizing of workers, and as a clear provocation to incite violence between the workers of Section 309 of the National Union of Miners and Metallurgical Workers of Mexico and the Napoleon Gomez Sada Union that the company has decided to impose.
As of November of 2010, ProDESC (the Project on Economic, Social, and Cultural Rights A.C.) has worked in the process of training and recognition of workers’ human rights in the Platosa mine, located in the municipality of Mapimí in the state of Durango, which is owned by Minera Excellon de Mexico S.A. de C.V., a subsidiary of Excellon Resources, Inc., a Canadian company that has developed mining activities in the state of Durango since 2004.
Since 2010, workers at Minera Excellon de Mexico S.A. de C.V. have fought an uphill battle to defend their labor rights. After the formation of Union Section 309 of the National Union of Miners and Metal Workers of Mexico, the company has used oppressive tactics such as widespread layoffs and the harassment of workers who demand the negotiation of their collective employment contracts and the recognition of their Section.
Today, the General Manager, Mr. Pablo Gurrola, pushed for a cease of labor and operations in the name of the Napoleon Gomez Sada Union, once again demonstrating the lack of willingness to respect a series of agreements that the company had reached with representatives of Section 309 of the National Union of Miners and Metallurgical Workers of Mexico, signed on August 18th of this year, following a legitimate stop of work of four days, led by the will of the majority of the mine’s workers and agreements that were also signed in the presence of the Secretary of Labor of the state of Durango Arturo Yáñez Cuellar and Deputy Secretary of Government of the Laguna Alberto Saucedo Reina Region, which to date have not been met.
In response, ProDESC demands that Excellon Resources Inc., complies with the commitments made to Section 309 of the National Union of Miners and Metal Workers of Mexico, and reminds the company that it is its responsibility and duty to respect the rights of freedom of association and union mobilizing of its workers, and to abstain from any interference in the life and autonomy of trade unions. Their actions are a clear violation to the Federal Labor Law and to Conventions 87 and 98 of the International Labor Organization. We must also remind Excellon’s management and directors that due to their committing human rights and labor violations, these have already been reported to the Canadian Government’s Office of the Corporate Social Responsibility Counsel.
Likewise, we urge the authorities of the Labor and Social Welfare Ministry of the State of Durango and to the Ministry of Labor and Social Prevision, to fulfill their duties to protect the rights of workers of Section 309 National Union of Miners and Metal Workers of Mexico, and to act with diligence and greater transparency to avoid further confrontations and unnecessary violence between workers of both Unions.
We demand that the Governor of the State of Durango Jorge Herrera Caldera avoid any act of repression that may undermine the physical integrity and rights of the workers of the Section 309 of the National Union of Miners and Metal Workers of the Mexican Republic.
